#1015: Can A Woman Delay The Observance Of The Missed Days Of Her Ramadaan So That She May Observe The Six Fast Of Shawwal

Yaa Shuyuk, May Allah Az-zawajal accept all of your effort as you are easing Islamic knowledge by giving everyone the opportunity to ask and within a short period of time the question/questions is answered with sufficient prove, I am really jealous of this great investment that the administration of this platform are piling up for them selves in Akhirah. I pray to Allah Az-zawajal that you earn His pleasure through this.

Question:
What is the best judgement on a woman who missed part of Ramadan due to menstruation and Sitta Shawwal with consideration to the Hadith of WHO EVER FAST RAMADAN THEN FOLLOW IT UP WITH SIX IN THE MONTH OF SHAWWAL….
and that of Aisha رضي الله عنها that she used to complete her Ramadan in Sha’ban?

ANSWER:

Wa Alaykum Salam Warahmatullah Wabarakaatuh.

May Allah accept your Du’a and grant ourselves and you Istiqaamah upon His Path, Tawfiq and Sadaad. May He also forgive us our numerous sins and make us of those whose fast has been accepted and who have been forgiven all their sins in the Month of Ramadaan, amin.

Know, may Allah bless you and your family with Guidance and Istiqaamah, that the position held by the Maliki, Shaafi’i and Hanbali Schools (in accordance with one of the narrations from Imam Ahmad) is that it is permissible for a woman who has missed some days in Ramadaan to delay its Compensation (Qadaa) until she has observed the Fast of the Six of Shawwal (Sittu Shawwaal). They considered it permissible but they dislike it.

The Hanafis consider it to be permissible and they didn’t dislike it.

The more mainstream position in the Hanbali School is that it is Haraam to do that without a justified reason. This was mentioned by Al-Bahuti in Kashshaafu Al-Qinaa.

The Strong position with regards to this matter is the position of the Hanafiyyah Madh’hab for they held that it was permissible and there is no any form of dislike in the doing of that even though it is better to put the compensation (Qadaa) for Ramadaan ahead of the Six of Shawwaal.

As for the Hanbalis, they had relied on a very weak Hadith that was recorded by Imam Ahmad from Abu Hurayrah that the Rasul salallahu alayhi wasallam said:

من صام تطوعاً وعليه من رمضان شيء لم يقضه فإنه لا يقبل منه حتى يصوم

“Whomsoever makes a fast that is Voluntary even though there is something of Ramadaan that he missed and has not compensated for, then that will not be accepted from him until he has fasted it”

In the Isnaad of the Hadith is the Muhaddith of Misr, ‘Abdullah Ibn Lahay’ah rahimahullah who is known for his weakness in Hadith as was mentioned by Adh-Dhahabi and others.

And the permissibility of observing the Six before the Compensation for the missed days of Ramadaan is strenghtened by the Hadith of Aa’ishah radiyallahu anha that was recorded by both Imam Al-Bukhari and Muslim that she said:

كان يكون علي الصوم من رمضان فما أستطيع أن أقضيه إلا في شعبان

“I used to have upon me missed days of Ramadaan Fast that I won’t be able to compensate for until Shaaban”.

Of the Ulamaa are those that hold that the reward of the Fast go Shawwaal is prefixed on the completion of the observance of the Fast of Ramadaan.

They said, this is because the Rasul salallahu alayhi wasallam said:

من صام رمضان ثم أتبعه بست من شوال كان كصيام الدهر

“Whomsoever observes the Fast of Ramadan and then follows it up with six fast of Shawwaal, it will be like the Fasting or an entire year”.

And this explanation and position is in the right direction, and this is why some of the Fuqahaa preferred that she finishes the Compensation for the Fast of Ramadaan first before she fasts the Six of Shawwaal unless if she has some conditions that warrant otherwise.

This is the right position on this matter and Allah knows best.
