#1095: Giving Sadaqah On Behalf Of The Dead
“What is the rullings of Sharia on giving out charity on behalf of a dead person, must it be given by his close relatives?”
ANSWER:
Know, may Allah bless me and you and grant us Tawfiq, that the Fuqahaa are agreed that it is permissible to give Sadaqah on behalf of the dead and that such Sadaqaat benefit them.
Shaykhu Al-Islam Ibn Taymiyyah rahimahullah said:
“Making Sadaqah on behalf of the dead and its likes benefits the dead in agreement of the entire Muslims” Jaami’u Al-Masaa’il.
Similar statements were made by Imam An-Nawawi in Al-Majmuu’u, Ibn Qudaamah Al-Maqdisi in Al-Mughni and others.
The proof for this is the Hadith that was recorded by Imam Al-Bukhari from Sa’ad bn ‘Ubaadah radiyallahu’ anhu who narrated that his mother passed away while he was away, and asked if giving Sadaqah on her behalf will be of benefit to her, he Salallahu Alayhi wasallam answered that it will benefit her.
In this account, Ibn Hajar Al-Haytami said in Tuhfatu Al-Muhtaaj :
“And the dead benefits from Sadaqah given on its behalf such as Mus’haf and its likes made as Waqf, well digging, tree planting either by the dead while it was alive or on its behalf after its dead”.
As for whether the giver of the Sadaqah must be a Close relative, there is nothing in the texts of the Shariah either verse or Hadith that stipulates that.
On this regard, Ibn Qudaamah Al-Maqdisi rahimahullah said:
“And any good deed he does and intends that it accrue for the dead, will surely benefit it (the dead regardless) insha Allah”.
