#1097: Can Tayammum Stand In The Place Of Ghusl If Water Is Later Found?

Pls urgent question: can someone that did tayamam after junub continue with a normal ablution without first do the guslu of junub?

ANSWER:

Alhamdulillah what we understand from this question is whether Tayammum can stand in the place of Ghusl if water is later found.

Firstly, know, may Allah illumine my face and yours, that Tayammum takes the place of Wudhu and Ghusl and makes permissible everything they both make permissible. This is because Tayammum was made permissible and was legislated as a temporal substitute for them both. The evidences for that are clear. And this is the position of the majority of the Fuqahaa.

Second, as for the one who is in need of Ghusl because he is Junub, and does not find water or is incapable of using water at the Time, if he later finds water, must he perform Ghusl?

In response to this, Al-Muglataayi said in his Commentary on Sunan Ibn Majaah:

“The Ulamaa have consensed that Tayammum does not permanently absolve Janaabah or Hadath, once water is found, and that whosoever made Tayammum on account of Janaabah or on account of Hadath must reverts back to a state of Junub or Ihdaath whenever water is found”

What the Imaam is explaining here is that Tayammum is a temporal replacement for Ghusl and Wudhu when water is not found. And then whenever water is found, it is obligatory to use water for purification. Except that we are not obliged to repeat what we have performed of ‘Ibaadah in the meantime when we were on Tayammum.

We hope this is clear.

The proof of this is the Hadith that was recorded by Imaam Al-Bukhaari from ‘Imraan bn Husayn radiyallahu anhu he said:

أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَأَى رَجُلا مُعْتَزِلا لَمْ يُصَلِّ فِي الْقَوْمِ ، فَقَالَ : يَا فُلانُ ، مَا مَنَعَكَ أَنْ تُصَلِّيَ فِي الْقَوْمِ ؟ فَقَالَ : يَا رَسُولَ اللَّهِ ، أَصَابَتْنِي جَنَابَةٌ ، وَلا مَاءَ . قَالَ : عَلَيْكَ بِالصَّعِيدِ ، فَإِنَّهُ يَكْفِيكَ

The Messenger of Allah saw a man sitting aloof and not observing Salaah with the people. He asked him, “O so and so! What prevented you from offering the Salaah with the people?” He replied, “O Allah’s Apostle! I am Junub and there is no water.” The Prophet said, “Perform Tayammum with clean earth and that will be sufficient for you.”

And in another Narration of the same Hadith, he added:

أن النبي صلى الله عليه وسلم وجد الماء فأَعْطَى الَّذِي أَصَابَتْهُ الْجَنَابَةُ إِنَاءً مِنْ مَاءٍ وقَالَ : ( اذْهَبْ فَأَفْرِغْهُ عَلَيْكَ ) .

“The Prophet salallahu alayhi wasallam later found water and then handed it over to the one who had Janaabah a container of water and said ‘go and wash yourself with it’ ”

Shaykh Muhammad bn Saalih Al-Uthaymin rahimahullah said concerning this:

“This is proof that Tayammum is a purifier and suffices in the place of water. But once water is found, it becomes obligatory to use it. And for this reason, the Prophet salallahu alayhi wasallam commanded him to wash himself with it without him having to have experienced another Janaabah”
