#1106: Should Leaders In Non Shariah Based Political Systems Be Given Excuses When They Fail?

“Sallam alaykum Dear esteem Shiek,how do we address the issue of people including the students of knowledge and sometimes some scholars in the case of giving every excuse committed by those in position of power especially the democratic and monarch settings but the Same group are very quick to lash out and condem the Slight mistake committed by Some Scholars, jazakumullahu khyran”

ANSWER:

Wa Alaykum Salam Warahmatullah Wabarakaatuh.

Alhamdulillah, we ask Allah for guidance and direction, for Iman and Tawfiq, for Sadaad and Istiqaamah, amin.

Know, may Allah guide me and you to the Path upon which there is rectitude, that Governing with the Shar’iah of Allah is an Obligation placed by Allah upon man.

This is a matter that is known of Islam by necessity and agreed upon by the entirety of the Muslims past and present. This is because unrestricted Obedience to Allah and His Messenger, and unrestricted following of the Guidance brought by the Rasul salallahu alayhi wasallam are among the Pillars of Ibaadah for which reason Allah created mankind.

In Suratu Adh-Dhaariyaat Allah said:

وَمَا خَلَقْتُ الْجِنَّ وَالْإِنْسَ إِلَّا لِيَعْبُدُونِ

“And I did not create the Jinn or man for any reason except that they render ‘Ibaadah to me Alone”.

The Mufassirun have explained, as was mentioned by Shaykhu Al-Islam Ibn Taymiyyah rahimahullah, that what ‘Ibaadah means saying it is an encompassing word that covers everything that a Servant does to earn the pleasure of Allah ranging from what is said to what is done apparently and discreetly.

For this reason, Shaykh Abdulaziz bn Abdillah bn Baaz rahimahullah said in his Risaalah on Tahkim:

“Making the Shariah of Allah the Judge in every matter is a necessary part of the testifying to Laa Ilaaha Illallaaah and that the Prophet Muhammad is His Servant and Messenger. This is because returning judgment to Tawaaghit, leaders soothsayers and others contradicts Imaan in Allah Azza Wajall. And this is Kufr, Dhulm and Fisq”

This is a clear matter about which two rams must not lock horns.

Can’t you see that Allah as a part of His Din has sent down upon His Messenger Laws and Judgements with which matters be resolved? Why then will a people shove that aside and refer to laws that they create of themselves if not a disregard for Allah and His Messenger and a disbelief in the Message of Islam?

And in Suratu An-Nisaa Allah said:

فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ ثُمَّ لَا يَجِدُوا فِي أَنْفُسِهِمْ حَرَجًا مِمَّا قَضَيْتَ وَيُسَلِّمُوا تَسْلِيمًا

“But no, by the Lord, they can have no (real) Faith, until they make thee judge in all disputes between them, and find in their souls no resistance against Thy decisions, but accept them with the fullest conviction.”

It is important for every Muslim to realize this. Muslims should not and must not be contented in any government that does not implement the Shariah of Allah in totality and whenever there is inability to do that, they must work toward it and dedicate their lives to its implementation. This is important to state.

Second it is important to know that it is obligatory upon a Muslim to excuse his fellow Muslim provided he knows good of him and can find an excuse for him.

In this regard, the Imaam Ibn Muflih mentioned in Al-Aadaab from Umar bn Al-Khattaab radiyallahu anhu that he said:

لا يحلُّ لامرئ مسلم يسمع من أخيه كلمة يظنُّ بها سوءًا، وهو يجد لها في شيء من الخير مخرجًا. وقال أيضًا: لا ينتفع بنفسه من لا ينتفع بظنه

“It is not permissible for a Muslim who hears a bad mention of his brother and which he is able to interprete it in good terms except that he does it.” He also said:” He benefits not himself whoeoever does not benefit others with his positive thoughts”

Likewise Imaam Ibn Battaal mentioned in his Commentary on Sahih Bukhaari from Ali radiyallahu anhu that he said:

من علم من أخيه مروءة جميلة فلا يسمعنَّ فيه مقالات الرِّجال، ومن حَسُنت علانيته فنحن لسريرته أرجى

“Whomsoever knows excellent of his brother then let him not entertain in his regard the speech of men. And whoever his apparent is excellent and good, then we are more hopeful that his private life is excellent”.

And there are several statements from Allah and His Messenger to the effect of this statement. It therefore cannot be over emphasized.

Then, if this is the general expectation from us regarding a people about whom we know good and excellence, that we should apply it with regards Ulamaa is more emphatic and more toward.

Can’t you see that these scholars have sacrificed their time and life to learn and teach us the Din?

Who else deserves that good be thought of him if the Scholars do not enjoy that?

It therefore is obligatory to think well of the Scholars provided they are known for truth and are consistent in truth. When they err, we overlook their errors provided it doesn’t sacrifice Islam and its precepts.

As for these Rulers whose do not implement the Ruling of Allah and willfully fight it or oppose those who call to it, there is no excuse that these ones are deserving. If they are not straight with Allah in His Commands, how can we think good about them?

May Allah guide our Ummah and grant us Tawfiq and Sadaad amin.
