#1124: On Whose Responsibility Is The Paying Of Zakaatu Al-Fitr
Will those who do fidya (because they can’t fast) will also pay zakatul fitr?
Can another person assist in giving zakatul fitr to the needy if one provide the money?
ANSWER:
Alhamdulillah
May Allah brighten our faces altogether and accept the little deeds of ours and magnify the rewards, amin.
Know, may Allah bless you, that Zakaatu Al-Fitr is obligatory upon every one of the Ummah who has the ability or whose Guardians have the ability to give it out. In the Hadith that was recorded by Imam Al-Bukhari and Muslim from Abdullah bn Umar radiyallahu anhuma, he said:
فَرَضَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ زَكَاةَ الْفِطْرِ، صَاعًا مِنْ تَمْرٍ ، أَوْ صَاعًا مِنْ شَعِيرٍ عَلَى الْعَبْدِ وَالْحُرِّ ، وَالذَّكَرِ وَالأُنْثَى ، وَالصَّغِيرِ وَالْكَبِيرِ مِنْ الْمُسْلِمِينَ ، وَأَمَرَ بِهَا أَنْ تُؤَدَّى قَبْلَ خُرُوجِ النَّاسِ إِلَى الصَّلاةِ
“Indeed the Messenger of a Allah Salallahu alayhi wasallam made obligatory Zakaatu Al-Fitr in the measure of a Saa’ of Dates, or a Saa’ of Barley upon every Slave or Freeman, Man and woman, minor or adult of the Muslims, and he commanded that it be given before the People set out for Salaah (on the Day of Eid). ”
It is based on this that the majority of the Fuqahaa and the Imams of the Muslims maintained that Zakaatu Al-Fitr is obligatory even upon the one who gave the Fidya on lieu of fasting. This is because it is known that the minor as in the Hadith above does not fast yet it was made obligatory upon him.
Only very few of the Fuqahaa among the Predecessors disagreed with this namely Sa’id bn Al-Musayyib and Al-Hassan Al-Basri rahimahumullaah.
This that we have mentioned was expatiated upon by Imaam An-Nawawi in his Commentary on Sahih Muslim.
