#1188: On Paying Sadāq in Isolation
In response to the Answer we gave in our last session of the Halqah, On the Ruling of a man paying the Sadāq after years of marriage. The Questioner further asked saying:
Asalamu aleikum Ustaz. Thanks for ur response. Throw more light. “Paying the sadāq in isolation” numbers of person as witness.
ANSWER:
Wa Alaykum Salām Warahmatullāh Wabarakātuh
There is no blame to pay the Sadāq to her without any witnesses. What must be witnessed is the ‘Aqd of the Marriage in the first place, not the Sadāq.
And we have preceded that while it is Mustahabb to mention the Mahr on the Day of the ‘Aqd and during it, it is not a condition for the marriage and it’s handing over to the bride does not have to he witnessed by the witnesses.
