#193: Ruling on a Wife giving away items without Her Husband`s Permission
QUESTION
ON A WIFE GIVING AWAY ITEMS WITHOUT HER HUSBAND’S PERMISSION
“What is the deed of a house wife who gave away items with out the husband’s knowledge.”
ANSWER:
Alhamdulillaah!
It is haraam for a wife to give out items belonging to the husband or belonging to the home as sadaqaah without the husband’s permission. Several Ahaadith point to this fact. The majority of the Ulamaa consider it makruh for her to make sadaqah with her personal items without his permission. And that is due to the rights of permission the husband has on his wife before she does anything.
Likewise, it is Haraam for her to make sadaqah with her own wealth without his knowledge unless where the family has an abundance of their daily needs in which case she doesn’t need his permission or knowledge.
However, what is mustahabb is for her to do everything she does with both his knowledge and his permission whether at times of abundance or times of stringency.
