#307: Can the Dead be Buried in the Masjid
*QUESTION*
” My question: is a grave accepted in the mosque premises.”_
*ANSWER*
Alhamdulillāh.
It is not permissible to bury the dead in the mosque neither is it permissible to turn the graveyard to a Mosque. Indeed there has come the Ahādith that is Mutawātir in which this act is expressly forbidden by the Rasūl – salallāhu alayhi wasallam. And some of the Hadīth, the doer of such act is cursed by the Rasūl – salallāhu alayhi wasallam.
In the Hadīth recorded by both Imām Al-Bukhārī and Imām Muslim, the Rasūl – salallāhu alayhi wasallam – said:
“لعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد
_”May Allāh curse the Jews and the Christians, they took the graves of their Prophets as Masjids”_
Imām Ibn Qayyim Al-Jawziyyah – rahimahullāh – said in _Zādu Al-Mi’ād_:
_”And based on this, every Masjid that is built upon a grave must be destroyed, just as every grave that is dug into a Masjid must be dug out. Imām Ahmad and other than him of the Imāms mentioned this. In the Dīn of Islām, a Masjid and a Grave must never be found together. Instead, whichever of both meets the other is forbidden and preference is given to the earlier. And if both were placed together at the same time it isn’t permissible. And if a Public Trust was established in this manner, it isn’t permissible. And in this kind of Masjid, it isn’t permissible to offer Salāt due to the forbiddance of the Rasūl – salallāhu alayhi wasallam – from that, and his curse on whosoever takes grave as Masjid or whosoever places lambs over it (graves). This is what is constituted in the Dīn of Islām with which Allāh sent His Messenger and Prophet to mankind as you can see.”_
