#422: Can a Waliy be the Wakil of the Groom

QUESTION

” Assalam alaikum I have a question pls.
Can my father be my waliy and the wakili of my groom?”

ANSWER

Wa alaykum salaam warahmatullāhi wabarakātuh.

Alhamdulillāh. We are very sorry for not answering your question promptly. Bārakallāhu Fīkum.

Firstly, it is important to know that Wikaalah (representation) of the groom is not among the Shuruut ( conditions) of Nikaah. Rather, it is a choice that most communities have taken as a tradition.

In that case, it becomes apparent that making your father in the situation described the Wakil of your groom is nothing necessary. Your husband can either represent himself or be represented by any of his friends.

However, had it been necessary, it is not permissible in accordance to the position held by majority of the Fuqahaa. That is because the essence of the ‘Offer and Acceptance’ is defeated.
