#44. REFUSING THE HUSBAND THE RIGHT TO PLEASURE DUE TO ILLNESS
” @ Admin, pls address this question: what if a woman is not feeling too okay and she refused her husband the pleasure due to her ill health or tiredness is it also a sin? Jazakallahu khair”
ANSWER
Alhamdulillaah!
It is obligatory upon a wife to respond to the sexual needs of her husband whenever he demands that of her. This is due to the Hadith in which the Rasul – salallaahu alayhi wasallam – said:
ﺇِﺫَﺍ ﺩَﻋَﺎ ﺍﻟﺮَّﺟُﻞُ ﺍﻣْﺮَﺃَﺗَﻪُ ﺇِﻟَﻰ ﻓِﺮَﺍﺷِﻪِ ﻓَﺄَﺑَﺖْ ﻓَﺒَﺎﺕَ ﻏَﻀْﺒَﺎﻥَ ﻋَﻠَﻴْﻬَﺎ ﻟَﻌَﻨَﺘْﻬَﺎ ﺍﻟْﻤَﻠَﺎﺋِﻜَﺔُ ﺣَﺘَّﻰ ﺗُﺼْﺒِﺢَ )
“If a man calls upon his wife to his bed and she refuses and he goes to sleep angry at her, the Angels curse her until the morning.”
The Hadith is narrated by Abu Hurayrah – radiyallaahu an hu – and recorded by both Imam Al-Bukhaari and Muslim in the Sahihayn.
The Fuqahaa are at a consensus on this obligation. The exemption to this is Only if she is menstruating or seriously sick in such a way that intercourse adds to her illness.
For this reason, Imaam Ibn Hazm Al-Andalusi – rahimahullaah – said:
“It is an obligation on the bondswoman and the wife that they not prevent the master or husband from intercourse whenever he requests that of them as long as she is neither menstruating nor Ill in a way that intercourse hurts her nor observing the obligatory fast. If she fails to and prevents him without a sound reason, then she is cursed.”

Therefore, tiredness is not a reason to prevent her husband from the pleasure of sexual intercourse neither is any kind of illness a reason. It has to be an illness which makes the intercourse painful or hurting to her.
These are some of the restrictions placed by the Shari’a to ensure that corruption is not spread on earth.
However, it is obligatory upon the husband to be considerate and merciful on his wife and not to demand of her what he knows will add more to her tiredness whenever that is the case.
