#55. WOMAN OBSERVING HAJJ WITHOUT A MUHARRAM

” Pls, can a woman go on hajj alone without a Muharram?”

ANSWER

Alhamdulillaah!

Know o brother that the Ulamaa have differed on this matter.

Imaam Maalik holds that it isnt permissible for her to perform the Hajj without a Mahram or her husband unless she has none to stand for her. In that case, it is permissible for her to go in a company of trustworthy people who are going all together.

Imaam Ahmad holds that an old woman may do that without a Mahram, Al-Marwazi and Al-Mardaawi related that from him.

The position of some of the Shafi’is, and that favoured by Al-Shiraazi – rahimahullaah – is the absolute permissibility of such for women young and old. However, it should be known that the matter discussed here is the obligatory Hajj and not the Hajj that is superoregatory.

The position of Maalik, Allaah knows best, is what is soundest.
