#579: Does swallowing the Saliva terminates the Fast?

QUESTION

” As-salamu alaykum. Admin, I’m wondering; does swallowing saliva during Ramadan nullify the fast?”

ANSWER

Wa alaykum Salām Warahmatullāh Wabarakātuh

Alhamdulillāh.

Imām Ibn Qudāmah Al-Maqdisī – rahimahullāh – mentioned in Al-Mughnī that the Fuqahā are at a consensus that swallowing saliva does not terminate the fast. And this is based on the fact that saliva is a part of man and is not something that can be avoided.

An-Nawawī in Al-Majmū’ mentioned that there is a minority position in the Mālikī School that considered gathering saliva and then swallowing it to be Makrūh (disliked). This was supported by Al-Mardāwī Ash-Shāfi’ī to be an opinion in the Shāfi’ī school too. But this minority position is weak for that which does not break the fast in its little should not break the fast in its gathering.
