#589: Does Involuntarily Vomit terminates the Fast
QUESTION
” Does involuntary vomit invalidates a pregnant woman’ fast”
ANSWER
Alhamdulillāh.
As for vomiting, the Ulamā are at a consensus that whosoever intentionally induces vomit, breaks his fast thereby.
While whosoever unintentionally vommitted, there is no blame on him/her and the fast is intact.
The ruling above is regardless of whether it is a man or a woman, and whether it is a pregnant woman or not.
Imām Al-Khattābī – rahimahullāh – said:
“I do not know of a difference among the People of Ilm that whosoever is overtaken by vomit and vomits, there is no compensation on him. Neither (do I know of a difference) concerning that whosoever induces vomit must compensate for it”
The proof for this is the Hadīth that was recorded by Al-Hākim, At-Tirmidhī and Abū Dāwud from Abū Hurayrah – radiyallāhu ‘anhu – that the Rasūl – salallāhu alayhi wasallam – said:
من ذرعه القيء فليس عليه قضاء، ومن استقاء عمدا فليقض
“Whomsoever was overtaken by vomit has no compensation obligatory upon him, and whosoever induces vomit and vomits must compensate (the fast).”
And the general precept in the Sharī’a is that people are not to be held responsible for what they did not incur.
