#602: Ruling on Investing in Harām Business
QUESTION
Can I Invest In A Business By Way Of Shares For A Company That Might Have Been Funded With Harām Capital?
” Asslamualaikum. Pls is it halal to buy a share in a business whereas it’s possible the company may have bn funded with haram capital base”
ANSWER
Wa alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh.
While the Ulamā differed as to the right response to any business dealings in which there is a possibility of Harām capital base and source of money, what is strongest, and Allāh knows best, is the position held by Ibn Taymiyyah rahimahullāh that what must be referred to here is the most probable.
If it is more likely that the capital base is Harām, then you should desist from such an investment. If it is more likely that it is Halāl capital, then there is nothing wrong in such an investment. But if you are completely on the path of equal probability, then you return to the pointers. If you know the bearers to be clean, then you assume same cleanliness with respect to their capitals, and vice versa. If you have no idea entirely, there is nothing wrong with such investments too.
