#610: Ruling on the Fidya of the Pregnant Woman
QUESTION
MUST A PREGNANT WOMAN’S FIDYA BE MADE BY HER IN RAMADĀN?
” Assalamun Alaykum! Pls, my question is; is it permissible for a woman who is pregnant and intends to pay fiddya but do not have the means during Ramadan, can she pay the fiddya outside Ramadan? JazakAllahu khayran”
ANSWER
Wa alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh.
May Allāh grant her safe and sound delivery and make her baby a model in Islām for generations to emulate, āmīn.
Firstly, we have stated earlier that it is not permissible for a pregnant woman not to fast unless she isn’t capable of doing that without difficulty. You may refer to our previous responses to similar questions.
Secondly, it should be known that if a pregnant woman is not able to observe the fast, she is not required to make the Fidyah unless it is not hoped that she will be able to make the fast compensated in a later date.
Thirdly, when it is established that she is to make the Fidyah (Feeding) in lieu of every fast missed by her, then it is preferred that she observes the Fidyah in Ramadān but not obligatory, and she may make it after Ramadān.
However it is not permissible for her to give out the Fidya before the Ramadān in question, i.e. before the fast she intends to miss.
An-Nawawī mentioned these in Al-Majmū’, likewise Ar-Ramlī Ash-Shāfi’ī – rahimahullāh.
