#684: Can a Man commands His Wife to Use Birth Control due to Fear of the Birth of Sickle Cell Infants?
QUESTION:
CAN A MAN COMMAND HIS WIFE TO USE PERMANENT BIRTH CONTROL TECHNIQUES DUE TO FEAR OF THE BIRTH SICKLE CELL INFANTS?
“Assalamu alaikum; (In reference to the answer 704 in IslamNode Q&A telegram channel) What if the husband ask his wife to go for permanent planning for fear of giving birth to a child with sickle cell, should she obey him? Jazakallahu khairan”
ANSWER:
Wa ‘Alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh.
It is not permissible for any man who fears Allāh and the Last Day to command his wife for a Permanent Birth Control Technique that alters her ability to conceive permanently due to this.
And it is not permissible for her to obey him in that if ever she is commanded as such by him.
This is because in the doing of that is sinning against Allāh.
And there is no obedience to the Creation in the disobedience of the Creator.
Imām Al-Bukhārī – rahimahullāh – recorded the Hadīth in which the Rasūl – salallāhu Alayhi Wasallam – said:
إنما الطاعة في المعروف
“Indeed Obedience is in matters of Good”
This is obedience to any authority we have been commanded to obey.
If the man feels he is so scared of such births and they both feel they cannot get along and be patient with the possibility of a Sickle cell birth, then they can agree to divorce themselves, and that is surely better than transgressing the limits of Allāh.
