#686: Ruling on Burying the Deceased by the River or Sea that cased his Death
QUESTION:
“Assalāmu Alaykum Warahmatullāh Wabarakātuh. Please Admin. Is it Islam to berried a deceased close to the river that killed him or her? Please Admin, with evidences please.”
ANSWER:
Wa Alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh!
Firstly, there is no stipulation in the Dīn that whosoever passes away by a river must be buried by it’s side.
It should be known that what is Sunnah is to burry the dead in the graveyard of the Muslims as was established by Ibn Qudāmah Al-Maqdisī – Rahimahullāh – in the Mughnī and An-Nawawī – rahimahullāh – in the Majmū’
If there are any superstitious beliefs in certain traditions that stipulates that a person be buried by the river that was the cause of his death, then such doesn’t come from Islām and is not so buttressed by it.
Secondly, if your question is as regards permissibility, then as mentioned, what is Sunnah is to burry in the graveyard but it is permissible to burry elsewhere if it does not lead to any harm, and as long as it is not the Masjid.
Someone once asked if it is permissible to burry inside the sea, the Ulamā have permitted that provided that you are travelling on sea and there is fear that waiting till you arrive at land will lead to the changing of the body of the dead.
This was the verdict mentioned by Al-Mawwāq Al-Mālikī and Imām Khalīl bn Is’hāq Al-Mālikī in the Mukhtasar – rahimahumullāh.
