#695: Ruling on Burying a Dead Dog to prevent Termites
QUESTION
“Asalamu Alaikum Warahmotullahi Wabarakatuh please admin I have very serious question which is disturbing us in our Muslim community here is it, TERMITES IS REALLY DISTURBING A MUSLIM COMMUNITY BUILDING WHERE OUR CHILDREN LEARNING QURAN AND WE PARENTS ARE PRAYING TOO AND RELIGIOUS ACTIVITIES IS GOING ON THERE TOO. CAN WE BERIED DEAD DOG OUTSIDE THERE SO THAT TERMITES WE NOT BE DISTURBING US AGAIN, BECAUSE THEY ARE TO MUCH AROUND THERE, PLEASE WHAT IS THE FATUA ABOUT IT”
ANSWER:
Wa Alaykum Salām Warahmatullāh Wabarakātuh
Alhamdulillāh.
Know, may Allāh illumine your heart, that the majority of the Ulamā have asserted that the dog is Najāsah (Impure). This was the position upheld by Al-Awzā’ī, Abū Hanīfah, Abū Thawr, Ahmad bn Hanbal, Is’hāq bn Rāhawayh, Abū ‘Ubayd and Ash-Shāfi’ī among the foremost Ulamā. Though some of the Scholars differed with them such as Mālik, Az-Zuhri and Dāwud Az-Zāhirī, the position of the majority is what is correct in this regard.
If then it is established that the dog is Najāsah, that it be distant from a place where the Book of Allāh is studied, where the Salāt is observed and where other pure Dīn activities take place becomes necessary by the Sharī’ah.
There are surely other means to distant these termites from homes and Islāmic schools and what is obligatory upon you and the entire community is to strive to use those means that would not require burying Najāsah around homes and schools vicinities.
May Allāh be merciful to us all and make your children the bearers of the Cause of Islām, amīn
Bārakallāhu Fīkum
