#790: Ruling on Court Weddings
790. QUESTION
“Asalamualaikum wa ramatullah wa barakallahu may Allah increase you in knowledge sir. I have a few questions. 1. Sheirk what the stand of Muslim who got married in court and also this wedding was done in the month of Ramadan. Is what they do Allowed according to Islam or not? Jazakallahu khyran”

Alhamdulillāh.
Amin to your Du’ā and May Allāh illumine your heart and soul, amīn.
The conditions for the validity of Marriage in Islām are known and established. They are the Consent of a Guardian of the bride, the Sadāq given by the groom or his Guardian, and the Offer of the Bride in marriage by her Guardian and Acceptance of same by the Groom or his Guardian, in the presence of 2 or more witnesses.
Anyone that goes to a Court to carry out Marriages that are not sanctioned by the Sharī’ah and that are carried out in anyway that does not meet the conditions mentioned above only wastes his time and if he or she builds on that court marriage only commits Zinā, we ask Allāh’s refuge from that.
The question that reads itself is why will a Muslim who believes in Allāh and the Last Day abandon the injunction of Allāh and the Sunnah of the Rasūl -salallāhu alayhi wasallam – in the observance of marriage and resort to the crooked ways of Courts?
Such a person need to be admonished and cautioned.
Such a Marriage, if the above conditions are not met, is null and void. And it doesn’t matter whether in Ramadān or not, it is void.
