878. QUESTION:

ANSWER:
Wa Alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh.
Backbiting is Harām in whatever shape or form and about whomsoever it is and it is only permisisble in the six cases that the Ulamā have mentioned:
1. By way of reporting a case to an authority to seek redress
2. By way of reporting to someone who can rebuke the person and correct him
3. When seeking Fatwah from a learned Person on the ruling of a deed or a person
4. When warning the Ummah from a person if he is harmful to the Muslims
5. Whenever the doer of a deed has done it openly and does not hide its doing then talking about it though he detests it is Permissible.
6. If it is a way of identification for him such as saying ‘the deaf’, ‘the blond’, etc.
This was mentioned by Imām An-Nawawī in his book Riyādhu As-Salihin and Al-Adh’kār.
