#178: Ruling on a Muslim Sister Marrying a Christian
190. QUESTION
CAN A MUSLIM SISTER BE MARRIED BY A CHRISTIAN?
“As-Salaamu Alaykum. Excuse me fellow Muslim, can I ask a question my daughter have a Christian Fiancé but the boy refused to become Muslim, can they get marriage but each with their own religion or is not permissible. please I need help for this”_
ANSWER
Alhamdulillāh.
It is not permissible for a Muslim sister to be married by a non-Muslim regardless of which other Religion he belongs. The generality of the Muslim Ummah, Ulamā and commoners are at a consensus on this.
Imām Is’hāq Ibn Khalīl – rahimahullāh – mentioned in the Mukhtasar:
وَالْحَاصِلُ أَنَّ الْإِجْمَاعَ مُنْعَقِدٌ عَلَى حُرْمَةِ نِكَاحِ الْكَافِرِ الْمُسْلِمَةَ كَمَا فِي التَّوْضِيحِ وَيُفْسَخُ
_”In summary, a binding consensus has been reached upon the impermissibility of a Kāfir getting married to a Muslim woman just as it was mentioned in At-Tawdīh. And such a marriage, (were it to take place,) must be nullified.”_
It wouldn’t have been permissible for her in the first place to have a Christian fiancé talk more of thinking of getting married to him.
We advise that you strongly advise your daughter to desist from such a relationship and if she does not listen to you, try enlisting the support of friends, scholars and other family members even if getting her a substitute brother is the way through.
