#186: Ruling on Observing the Salāt behind the One who is making up for Salāt
QUESTION
ON OBSERVING THE SALĀT BEHIND ONE WHO IS MAKING UP WHAT HE MISSED FROM ANOTHER IMĀM
“Please explain, is this allowed: a man joins the Imam at 3rd rakah and completes his rakah after the Imam finishes. Some people joined him making him the imam while he is completing his salah”
ANSWER:
Alhamdulillaahi Rabbi Al-Aalamin
There is a difference of position regarding that among the Fuqahaa.
The Shafi’i and Hanbali schools hold the permissibility of that based on the differences of intention and the Hadith that establishes the permissibility of someone who is observing a Superogatory Salaat (Naafilah) following someone who is observing an Obligatory Salaat (Fard) and vice versa.
The Maaliki position is the impermissibility of that and they based their position on the fact that the Imaam’s Intention must agree with the followers Intention and the Imaam must, right from the onset, hold the intention of leading others in the Salaat.
Aside that, they explain that there is no authentic report from any of the predecessors that they did that.
What is soundest is that such an act is impermissible unless in a situation where there is nobody that can be found within the time range of the Salaat that you can observe the Jam’ with, then in that case, you can join such a person and observe the Salaat behind him.
