#1022: Can A Girl Who Was Raped Continue Her Fast?
“Salam alaikum ya admin Allah continue to protect you and everyone else on this platform. Please a quick one sir and it is quite urgent sir.
A girl of age 18years old was force into sex immediately after she broke her fast by a grown Christian man. I was told the man used to send the young girl and errand but later took advantage of her by forcing her into sexual intercourse against her will. The question is, can she continue fasting?”
ANSWER:
Wa Alaykum Salam Warahmatullah Wabarakaatuh.
Alhamdulillah.
In the case of this girl, she must continue her fast nonetheless.
If you mean that she was forced into intercourse by way of rape in daytime, then there is no sin on her and there is no compensation for the Day that that was done on her after the month has ended. This is if she was forced and raped.
This is because the Rasul salallahu alayhi wasallam said:
إن الله تـجاوز لي عن أمتي الـخطأ والنسيان وما استكرهوا عليه
“Indeed Allah has overlooked for me for my Ummah that which was done in error, that which was forgotten and that upon which they were forced”
This is the stronger position on this matter.
However if you mean that she was seduced and snared into it by the Man, then she is a wilful participant in the act.
Then in this case, the position of Imam Ahmad, Maalik and Abu Hanifah is that she has to observe the Kaffaarah of the Fast after the month of Ramadan as a punishment for having the intercourse in the Month.
The position of Ash-Shaafi’i is that there is no Kaffaarah upon her since she is the weaker gender and was seduced into it. And Allah knows best.
If your question instead mean that the act was after she has broken her fast and happens at night time, then this has no effect on her fast whatsoever but, that which is Compulsory upon her and upon the Muslim community in the Community where she lives is to leave everything that exposes her to that sort of man.

It is obligatory to use any means necessary and possible to prevent the occurrence of such happenings.
