#1049: On Trading With The Christians For Christmas Celebration
“As salaam alaikum yaa uztaz, May Allaahu keep up upon goodness. Christians approached me to sell to them goats for the period of Christmas, am I prevented from trading? Kindly respond with evidence. May Allah guide you”
ANSWER:
Wa Alaykum Salam Warahmatullah Wabarakaatuh
May Allah accept your Du’a and grant you Tawfiq amin.
Alhamdulillah.
Provided it is known to you that these goats are specifically sought after for the purpose of celebrating Christmas and for nothing other than that, it is not permissible for you to carry out that transaction. This is because the doing of that is assisting them in their Eid. And assisting them in their Id is Haraam by the consensus of the Fuqahaa.
Ibn Taymiyyah said in his book Iqtidaa Siraat Al-Mustaqim:
“As for Muslims selling to them (the Kuffaar) on the days of their Eid that with which they use in celebrating their Eid such as food, clothes, basils and the likes o gifting that to them, in this is a form of assisting them in establishing their Haraam Eid”
It is also known that this act is Haraam in accordance with the Maliki Fiqh. The Maliki Jurisconsult and Polymath Ibn Habib is known to have ruled to this effect.
Ibn Qayyim Al-Jawziyyah mentioned this in Ahkaamu Ahli Adh-Dhimmah and Ibn Taymiyyah in Fataawah Al-Kubraa.
This is also the position in the Shaafi’i Madh’hab as was referred by Ibn Hajar Al-Haytami Al-Makki in Al-Fataawah Al-Fiqhiyyati Al-Kubraa. Where he held that it is an agreed upon principle in the Madh’hab that whatever is known is specifically purchased to help in their celebration on that day, it is not permissible to sell to them.
