#1055: Is It Permissible To Have Sexual Intercourse With Your Spouse On The Night Or Early Morning Hours Of The Day Of Id Ad’ha?
“Assalamun alaykum Wa rahmatulLAh wa baraakatuh My question is, since we won’t be eating till when we return from eid, on Thursday night after iftar can couples be intimate, even around fajr time. Does it nullifies the eid day fast?”

Alhamdulillah,
As for fasting on the Days of Id, then it is Haraam by consensus. This forbiddance encompasses both Id’s without an argument among the People of Islam. This is due to the generality of the emphasis with which fasting on any of these two days were prohibited by the Rasul salallahu alayhi wasallam.
As for the Hadith that was recorded by Imam Ahmad and Abu Isa At-Tirmidhi from Buraydah radiyallahu anhu that:
كان النبي صلى الله عليه وسلم لا يخرج يوم الفطر حتى يطعم، ويوم النحر لا يأكل حتى يرجع فيأكل من أضحيته
“The Prophet salallahu alayhi wasallam did not used to go out on the Day of (Id) Al-Fitr unless he had eaten and on the Day of Sacrifice (Ad’ha), he would not eat until he returns (from the Prayer) then he would eat from his slaughter”
Then know that what is established by the Fuqahaa is that this is a Sunnah and it is not referred to as a fast that takes the rulings of Fasting. Rather it is mentioned that he would not, eat something until he had returned from the Prayers.
Some of the Fuqahaa, such as the Imam Abdurrahman Al-Mubaarakfuri the author of Tuhfatu Al-Ahwadhi mentioned that the wisdom in that is that the Rasul salallahu alayhi wasallam wanted to eat at the time that the Fuqaraa (Poor and Needy) would eat.
On the Day of Al-Fitr, the recommendation is to give out the Zakaat Al-Fitr before the Prayers and on the Day of Slaughter, it is done and distributed after the people have returned from the Id. This withholding from eating at the earlier hours of the day of Nahr is not regarded as fasting for which the Ahkaam of the fast applies.
Then, if it was said that all of the Ahkaam of the Fast applies to it, it should be known that the Ulamaa are agreed that this withholding from eating is not regarded as a Fard (Compulsory) act. There is therefore no blame on a couple that go intimate.
