#313: Can the Groom be Represented During the ‘Aqd of His Nikāh?*
*QUESTION*
“As salam alaykum warahmatullah wabarakaatu. On the marriage issue, Can person represent me In case the lady agree to the arrangement if I am not chanced to be present at the aqdu nikkah. Please help answer it.”_
*ANSWER*
Wa alaykum Salām Warahmatullāh Wabarakātuh
Alhamdulillāh.
The ‘Ulamā from all of the Madhāhib have agreed that it is permissible for the groom to be represented during the ‘Aqd of his Nikāh. The evidence for this is the Nikāh of the Rasūl – salallāhu alayhi wasallam – himself to Umm Habībah Ramlah bint Abī Sufyān Sakhr Ibn Harb Al-Qurashiyyah Al-‘Umawiyyah – radiyallāhu ‘anhā. The Ulamā are in agreement, as the ‘Allāmah Imām Ibn Qayyim Al-Jawziyyah – rahimahullāh – mentioned in his Hāshiyah on Al-Mundhirī’s Mukhtasar on the Sunan of Abī Dāwud, that the Rasūl – salallāhu alayhi wasallam – was represented there by the Habashī King An-Najjāshī – radiyallāhu ‘anhu.
