#396: Ruling on Speaking in the Lavatory

QUESTION

” Assalaamu alaykum wa rahmatullah. which is the most correct opinion regarding talking in the toilet, mentioning Allahs name or reading some few ayaats loudly in it?”

ANSWER

Wa alaykum salaam warahmatullaah wabarakaatuh

Alhamdulillaah Wa as-Salaatu Wa As-Salaamu ‘Alaa Rasulillaah!

Regarding speaking in the lavatory while either urinating or passing out faeces, the Ulamaa have agreed that it is prohibited unless when the matter is one of urgency.

Imaam Ibn Hajar Al-Haytami – rahimahullaah – said in ‘At-Tuhfah’:

“Even if it is a word of Dhikr and returning the Salaam, (it remains impermissible) the reason been that it has been forbidden to speak while passing out faeces. And if he sneezes, he should say ‘Alhamdulillaah’ in his heart only…”

It is mentioned in ‘At-Taaju Wa Al-Iklil ‘Ala Mukhtasar Khalil’:

“It is not permissible for anyone to speak while he is squating to ease himself. Iyaad said: salam should not be made to him, neither should he reply to salam.”

The evidence for this is the Hadīth recorded by Imaam Abu Daawud in the Sun an where the Rasūl – salallaahu alayhi wasallam – said:

((ﻻ ﻳﺨﺮﺝ ﺍﻟﺮﺟﻼﻥ ﻳﻀﺮﺑﺎﻥ ﺍﻟﻐﺎﺋﻂ ﻛﺎﺷﻔﻴﻦ ﻋﻦ ﻋﻮﺭﺗﻴﻬﻤﺎ ﻳﺘﺤﺪﺛﺎﻥ، ﻓﺈﻥ ﺍﻟﻠﻪ ﻳﻤﻘﺖ ﺫﻟﻚ))

“Two men will not go out excusing themselves, passing out faeces, exposing their private parts and discussing together except that the wrath of Allāh will be upon them.”

Shaykh Muhammad Naasiruddin Al-Albaani – rahimahullaah – declared it Hasan in ‘Sahihu At-Targhib’.

And the Hadith in which a man passed by the Rasūl – salallaahu alayhi wasallam – while he was urinating and made the Salām to him, he – salallaahu alayhi wasallam – did not respond to his salam. This Hadith is recorded by Imaam Muslim from Abdullah Ibn Umar.

An-Nawawi said in Al-Majmu’ that this forbidding is agreed upon by the Ummah.

It is worse if the name of Allāh is mentioned in this situation. This is because it is denigrating to mention the name of Allāh in such a dirty place or a denigrating position. It is known that the Rasūl – salallāhu alayhi wasallam – did not mention the name of Allāh while he was in the lavatory.

As for speaking in the modern toilets that are attached to the home and are very clean and free from filth, there is nothing wrong to do that as long as one is not in the process of urinating or passing out faeces.

As for mentioning the name of Allāh in such modern home toilets, it is not allowed, no matter how clean and well kept they are. This is as a way if honouring the Names of Allāh.
