#491: The Use of Toothpaste or Siwak while Fasting
QUESTION
” Pls can we brush with tooth paste or use siwak if u forget to brush in the time of suhuur”
ANSWER
Alhamdulillāh.
It is permissible to do that by the consensus of the Ulamā.
Imām Al-Bukhaari – rahimahullāh – said in his Sahih:
ﻭﻳﺬﻛﺮ ﻋﻦ ﻋﺎﻣﺮ ﺑﻦ ﺭﺑﻴﻌﺔ ﻗﺎﻝ : ﺭﺃﻳﺖ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻳﺴﺘﺎﻙ ﻭﻫﻮ ﺻﺎﺋﻢ ﻣﺎ ﻻ ﺃﺣﺼﻲ ﺃﻭ ﺃﻋﺪ .
“And it is mentioned from Aamir Ibn Rubay’ah who said:
I saw the Prophet – salallāhu alayhi wasallam – observing the Siwaak while he was observing the fast many times than I can count or enumerate.”
The Shafi’i and Hanbali position is that it is makruh for the fasting person to observe the Siwaak after the sun has passed its zenith (zawaal)
The Malikis hold that what is makruh is to use a wet siwaak whether before or after the zawaal.
While the Hanafi verdict is that that there is nothing makruh about it either before or after the Zawaal and there is nothing wrong with the dry one before or after.
Maliki position tallies with one of the narrations from Imām Ahmad – rahimahumallaah – What is sound, and Allah knows best is that there is nothing wrong or makruh about whether using the wet or the dry siwaak, whether before or after the zawaal.
Using the toothbrush, by Maliki standards will fall under Makruh since they dislike the use of wet Siwaak.
The correct position as we have said, and Allah knows best, is the Hanafi position.
And what we have said is what majority of the Muhaqqiqun hold unto. Allāhu A’alam.
