#676: Ruling on Donating One`s Organs to the Needy
QUESTION
“Assalamu’alaykum, pls is it permissible to donate your organs to a sick person or to sign that your organs be harvested and donated after death….”
ANSWER
Wa Alaykum Salām Warahmatullāh Wabarakātuh.
Alhamdulillāh.
The Ulamā of this era have agreed that it is Permissible to donate an organ to a person who needs it provided it is free of any medical risks and this is carried out by qualified medical personnel.
Likewise, it is permissible that organs be given after death as long as such organs are safe for the one to whom it is donated and permission for the implementation of this is sought from the family of the deceased.
But it should be noted that it is Harām for these organs to be sold or procured with money. This is because it is Harām to earn income by the sale of Human parts.
All of these fall under two established precepts in the Sharī’ah:
The Precept of Necessity.
And the Precept of Saving life.
By such saying, all the restrictions that govern these two precepts as outlined by the Ulamā in the books of Qawā’id must apply.
