#763: The Authenticity of the Hadīth in which a Woman corrected ‘Umar Bn Al-Khattāb on the Sadāq of Marriage
763 QUESTION:
“Question: Assalamu alaykum warahmatullah. Please how authentic is the narration that said a woman corrected Umar on the issue of dowry?”
ANSWER:
Wa Alaykum Salām Warahmatullāh Wabarakātuh, Alhamdulillāh.
As for the Narration to which you refer, it was recorded by Sa’īd bn Mansūr in his Sunan that Umar bn Al-Khattāb – radiyallāhu ‘anhu – gave a speech on the Minbar and said: “And do not be extravagant in Sadāq of Women.” Then when he came down from the Minbar, a woman of the Quraysh said to him: “O Commander of the Believers! You have forbidden people from been expensive with the Sadāq of Women but Allāh had said:”
وَآتَيْتُمْ إِحْدَاهُنَّ قِنطَارًا فَلاَ تَأْخُذُواْ مِنْهُ شَيْئًا
“So when you divorce a woman and you have given one of them (your wife) the treasure (of her Sadāq), do not take of it anything…”
Then Umar said: “Everyone has more knowledge of Fiq’h than Umar” he said this twice or thrice. Then he returned to the Minbar and said to the people.
“I forbade that a man should be expensive with the Sadāq of women. But a man may do in that regard with his wealth what pleases him.”
I say: Imām Al-Bayhaqī Al-Khurasānī also recorded this Hadīth in his Sunan and mentioned in it’s end:
“The Chain is broken”
And the stronger position that has been established by the Ulamā is that all the other three variant chains of this same Hadīth have one or more ills and problems in them that make them incapable of strengthening themselves to authenticity, Shaykh Muhammad Nāsiruddīn Al-Albānī – rahimahullāh – mentioned in Al-Irwā that it was weak, following the positions mentioned by the Imāms of Hadith before him.
We are aware that Shaykh Mustafā Al-‘Adwī considered it Hasan, what is stronger is that it is weak, and Allāh knows best.
