#803: Ruling on keeping the change from a purchase done on behalf of someone else If He does not expect the Change

803. QUESTION

“pls if someone gv u money to help him or her to buy something nd u buy d thing less dan what he or she gv u nd u decided to keep d balance pls what is d ruling of islam on it”

ANSWER:

Alhamdulillāh

As for this, a person who buys on behalf of someone else is his Wakīl (representative) in that transaction. His ruling in that transaction is the ruling of the one he is representing. Likewise everything he does is on behalf of the one he is representing. This is known and agreed upon.

Now, when he bargains for a less price, he does that on behalf of the one he represents and the benefit earned must be returned and mentioned to the one he is representing unless he overlooks and allows him to have it.

This is what the Fuqahā have arrived at on this matter. It was mentioned by Imām Ash-Shāfi’ī in Al-Umm, by Al-Bahūtī in Kashfu Al-Qinā and Ibn Najīm in Al-Bahru Ar-Rā’iq.

In the Hadīth recorded by Imām Al-Bukhārī, the Rasūl -salallāhu alayhi wasallam – sent the Sahābī ‘Urwah bn Al-Ja’ad Al-Bāriqī – radiyallāhu ‘anhu – with a Dīnār to purchase for him a ram. Ja’ad was a clever and resourceful man. He was able to acquire two Rams with the money the Rasūl -salallāhu alayhi wasallam – gave him. He therefore sold one of the Rams for one Dīnār then returned to the Rasūl -salallāhu alayhi wasallam – with a ram and a Dīnār.

It is therefore Harām for you to take that balance and it is a form of deception and cheating unless you tell him and he allows that you take the balance. And Allāh knows best.
