#823: Ruling on eating Snakes

823. QUESTION

“As-salamu alaykum pls, is eating of snake permissible in Islam”

ANSWER:

Wa Alaykum Salām Warahmatullāh Wabarakātuh.

Alhamdulillāh!

We answered in Question 351 the matter of eating snakes and we favoured the Shāfi’ī and Hanbalī Schools position that the eating of snakes was Harām due to the Generality of the forbiddance of eating animals we were commanded to kill anywhere they are found and in whichever position we are in, even if in Ihrām, and it is known that the Rasūl -salallāhu alayhi wasallam – mentioned snakes among them. We also mentioned that the Mālikī position is Permissibility as long as it is not poisonous, and we explained why the Mālikī position is weak on this.

In response to Question 354 we mentioned that if a Snake lived in water and doesn’t come on land, the stronger position is it’s Permissibility due to the general Permissibility of eating aquatic animals, though some Ulamā differed on that, and we explained.

What we didn’t mention in any of those answers is the Ruling of using Snakes for cures to diseases.

We say, and help comes from Allāh, this is Harām due to the general ruling of the forbiddance of seeking cures in that which Allāh has forbidden.

Imām Al-Bukhārī mentioned from ‘Abdullah bn Mas’ūd that he said:

إِنَّ اللَّهَ لَمْ يَجْعَلْ شِفَاءَكُمْ فِيمَا حَرَّمَ عَلَيْكُمْ

“Indeed Allāh has not placed your cures in that which He has forbidden to you”

This is a matter agreed upon by the Fuqahā.

From Allāh all Tawfīq is sought.
