#867: Do I have a share in the Sin my tenant commit while using my facility?
867. QUESTION
And please what is the rulings on renting out a house to man you know he commits Zinā, do you have a share when he sins?
There is one more question releted to it
for instance i am giving my place for rent. Software company renting it. Should i ask them what kind of software do they make? and for instance from 50 clients of theirs one that is not inline with islam, am i gonna be responsilbe for that
to which extent do we have to make such inquiries in such situations
ANSWER:
Alhamdulillah. Know and may Allah have mercy on us all that the ruling of such is same as the ruling for selling grains to the non-Muslim that takes alcohol.
Just as the grains can be used in different ways that are halal, that is how a house can be used for different things that are halal.
Thus, it is wrong to conclude negatively in such cases that can take various meanings. And for you giving out the rent in such ambiguous situation will not be regarded as sharing in the sin he did later because you didn’t rent the house to him for that purpose. Rather you rented it to him for the Halal purpose of taking shelter in it which is a fundamental need of all humans.
However, in the case where you are sure that the person is not repentant or apologetic of his behavior (ie the person is not ashamed and does things openly that makes people know without doubt what he mostly engage in privately) and he might affect the youth in the neighborhood with his character, and there is no way the community can positively affect and put him in check in order to make him a better person, then it is strongly recommended not to rent out the house to such a person.
