#898: Is eating the Slaughtered Meat of the Mushrikun aside the People of the Book permissible?

898. QUESTION:

“Assalamu alaykum Wa rahmatullah Wa barakatuh…If Muslims are allowed to eat the slaughtered meat of the ahlul Kitab, can we say the same for eating slaughtered meat of other disbelievers like neighbors or relatives who are atheists”

ANSWER:

Wa Alaykum Salām Warahmatullāh Wabarakātuh.

Alhamdulillāh!

The One Word Fatwah that is the Edict from our Fuqahā, and which is an Ijmā’, except for very very strange positions such as that mentioned by Ash-Shawkānī, is the forbiddance of consuming the slaughtered meat of the Mushrikun.

The only Kuffār we are permitted to consume their slaughter are the People of the Book: Jews and Christians even if they did not mention the Name of Allāh in their Slaughtering. As for the Magians (Majūs) the Majority of the Fuqahā hold that they are treated like other than the People of the Book except for Sa’īd bn Musayyib and Ibn Hazm in the later Era. And their reason is that they considered the Magians to be of the People of the Book.

Ibn Hazm Al-Andalusī rahimahullāh said in Al-Muhallā:

“It is not Permissible to eat that which is slaughtered by other than a Jew, a Christian or a Magian… As for the Magians, then we have explained in Kitābu Al-Jihad that they are of the Ahlu Al-Kitāb this their ruling is same as that of the Ahlu Al-Kitāb in everything…”

And the position of Ibn Hazm Al-Andalusī on the Magians is very weak. Majority of the Ulamā we’re Stern on him in this matter for they considered the Magians to be of the Mushrikun the eating of whose slaughter is considered by consensus to be Harām.

Al-Qurtubī rahimahumullāh said in his Tafsīr:

“The Ulamā are at a consensus, except for the one who strays off from them, that their (the Magians) slaughter is not eaten neither is their women married because they are not of the Ahlu Al-Kitāb in accordance with the popular position among the Ulamā”

But the People of Islām Past and present and the Fuqahā are at a consensus that the slaughter of the Mushrikun is Harām for consumption. This Consensus was mentioned by all of the Mufassirun in their Tafsīr of the Verse:

الْيَوْمَ أُحِلَّ لَكُمُ الطَّيِّبَاتُ وَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ

“Today the things that are pure have been made Permissible for you, likewise the slaughter of those who were given the Book (before you) has been made Permissible for you”

Imām Al-Jassās said in his Commentary on the Text of At-Tahāwiyyah:

“The Slaughter of a Kāfir who is not of the People of the Book is Harām, and it is not Permissible to marry their Women. There is no difference known to us on this matter”

Shaykhu Al-Islam Ibn Taymiyyah said in the Majmū’ah:

“As for the Mushrikun, the Ummah are in agreement that Marriage to their women and their slaughter is Harām”
