#1165: Ruling on receiving Payment for Work not done in the NPower Program

QUESTION:

“As salaamu alaikum wa rahmatullah wa barakaatuh yā fadēlatal asātedha.

I have two questions presented before you – may Allāh be with you – as was presented to me few days ago.

Question 1: concerning the Npower program, some people actually receive monthly stipend while they stay at home without going to their Npower place of assignment and they will give reason that it is a national cake. Is it allowed to receive this Npower monthly stipend without working for it and also is it allowed for some one to fake certificates so as to get the empowerment?

ANSWER

Wa Alaykum Salam Warahmatullah Wabarakaatuh

Know O beloved one that Allah obligated that trusts be returned to the people who entrusted us with them in several places in the Qur’an. Of them is where he said:

إِنَّ اللَّهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا

“Indeed Allah commands that you fulfill and return the trusts to the rightful owners”

By the consensus of the Ulamaa, employments is a form of trust that the employee is entrusted with in which case there is an agreement or Offer that is signed or accepted in principle or literally to abide by certain conduct and within certain time span stipulated and laid down. It therefore is not permissible for a person to truncate any of those agreements unilaterally from his own end without recourse to his employers, and it is not OK and not proper to say things like everyone does it or it is a national cake.

Don’t you see that you have signed an agreement or agreed in principle to abide by the hours of duty or working hours as the case may be?

The Ruling of the employer or the personality of the employer has no impact whatsoever on the obligation of abiding by the conduct agreed upon or the contract of employment offered.

Thus, you can’t claim that your employer is a Kaafir so you have a free hand to fail in your principle or to betray the trust you are entrusted with.

In the Hadith that was recorded by Imam Ahmad and the Recorders of the Sunan, from Samurah, the Rasul salallahu alayhi wasallam said:

أد الأمانة إلى من ائتمنك، ولا تخن من خانك

“Deliver and fulfill the trusts to the one who entrusts you and do not betray the one who betrays you”.

The command is generic and includes all forms of trusts and all categories of people.

There is no permissibility to do what you are asking about, and Allah knows best.
