Allah Ta’ālā’s Ruling on the Rulers that substitute the Shari’ah of Ar-Rahmān

بسم الله الرحمن الرحيم

TRANSLATION OF THE TREATISE:

حكم الله تعالي في الحكام المبدلين لشريعة الرحمن

Praise be to Allah the Lord of the Ālamīn

The Salutations and the mention of praises of Allah be on the Trustworthy Prophet and upon his family and his companions altogether.

And therefore…

Indeed, knowing the verdict of Allah Ta’ala on the Rulers that substitute the Shari’ah of Ar-Rahman is a wajib on every Muslim and it is not of the superogatory deeds. That is due to the delicate issues and excellent deeds that follow up such ruling. Of its most important is Bara’a from them and not going under their obedience; and the obligation of raising arms against them – as it is the Ijma’ of the predecessors among the people of knowledge.

And for that reason, the claimants have claimed that the likes of these issues busy and occupy the Muslims from da’wah to Allah or that it distracts him from seeking knowledge; or that it results into some mafasid.

And this is a false claim which has no basis in the Shari’ah since our Salaf have reached a consensus that the Kufr of the Mulhidin (Secularists) is a necessity among the necessities of the Din and especially if these secularists are in the decision – making and authority stratas.

And let the Muslims know that being silent over these Rulers who change the Shari’ah of Ar-Rahman has caused for our Ummah calculations, disasters and tribulations since it made the many of the Muslim forces for these Tawaghit without them knowing, and therefore they become a part of the band of Riddah and Kufr, especially in the Ahkam (Rulings) of fighting.

And in silence over them also is a clearing of the Path for their false ideologies and their constitutions to pass over the Ummah of Muhammad – ﷺ, this with their constitutions Haram money was made Halal, Haram private parts were made Halal, Error and oppression were used to judge between people in issues relating to blood; Apart from what follows their Laws of the wasting of the land and its destruction, the promotion of poverty, oppression and sins that Allah Ta’ala has prohibited and people began to flush out of the Din of Allah Ta’ala without fear and hesitation; the governmental cooperations which were tools under these Kufr Rulers began to spread and promote promiscuity, encouraging and inciting sins and beautifying Kufr and the Path of the Kafirin.

Until the statement of Allah became true regarding us:

((فخلف من بعدهم خلف أضاعواْ الصلاة واتبعواْ الشهوات، فسوف يلقون غيا)) مريم: 59

“Then, there has succeeded them a posterity who have given up As-Salat (the prayers) and have followed lusts. So they will be thrown in Hell.” MARYAM: 59

And like what He – Subhanahu Wa Ta’ala said:

((ظهر الفساد في البر والبحر بما كسبت أيدي الناس…)) روم: 41

Evil has appeared on land and sea because of what the hands of men have earned (by oppression and evil deeds, etc.) RUM: 41

And this is the result of turning away from the Shari’ah of the Lord of the Earth and the Heavens.

Therefore, of the most important things that are obligatory upon the Muslim in this era of ours to know; is the Ruling of Allah Ta’ala on these Hukkam (Rulers).

Know O my Muslim Brother – may Allah Ta’ala protect me and yourself from all evils and wrongs and may Allah elevate us above every lowliness and sin;

That the changing (tabdeel) of the Shari’ah is Kufr (disbelief) in the Lord of the Heavens and the Earth and what is implied by “tabdeel” is to title what Allah declared legal as “Illegal” or to call what Allah made Illegal as “Legal”, this is because what is legal is what Allah made ‘Legal’ (Halal) and what is Haram is what Allah Ta’ala made to be haram, so just as the creation is His Creation, the commandments are His Commands. He Ta’ala said:

((…ألا له الخلق والأمر، تبارك الله رب العالمين)) الأعراف: 54

“His is the Creation and Commandment. Blessed be Allah, the Lord of the Alamin.” AL-A’ARAF: 54

Thus, whoever claims that the command regarding what is Halal and what is Haram is to other than Allah Ta’ala; is a Kafir and his Kufr is exactly like he who claims that there is a Creator beside Allah Ta’ala, He – Ta’ala – said about that:

((ياصاحبي السجن ءأرباب متفرقون خير أم الله الواحد القهار* ما تعبدون من دونه إلا أسماء سميتموها أنتم وءاباؤكم ما أنزل الله بها من سلطان، إن الحكم إلا لله، أمر ألا تعبدواْ إلا إياه، ذالك الدين القيم ولكن أكثر الناس لا يعلمون)) يوسف: 39-40

“O two companions of the prison! Are many different lords (gods) better or Allah, the One, the Irresistible? You do not worship besides Him but only names which you have named (forged), you and your fathers, for which Allah has sent down no authority. The command (or judgement) is for me but Allah, He has commanded that you worship none but Him (i.e. His Monotheism), that is the (true) straight Din, but most men know not.” Yusuf: 39-40

So look – may Allah protect me and you – how he restricted legislation to Him Alone and called that Ibadah; and he made the Upright Din to be this Affair. Thus the Din is Ibadah and Ibadah is to be humble to the Ruling of Allah Ta’ala. And for this reason, whomsoever humbles himself and obeys other than the Ruling of the Lord of the heavens and the Earth has already rendered Ibadah to other than Allah Ta’ala and he is an adherent of another Din other than the Din of Muhammad (SAW) for the Din is Government and Legislation; He – Ta’ala – said:

((…ما كان ليأخذ أخاه في دين الماك إلا أن يشاء الله، نرفع درجات من نشاء، وفوق كل ذى علم عليم)) يوسف: 76

“… He could not take his brother by the law of the king (as a slave), except that Allah willed it. We raise to degrees whom We please, but over all those endowed with knowledge is the All-Knowing.” Yusuf: 76

And it has been known that the Din of the King is his Ruling and his legislation. Therefore, whomsoever lowers himself to the Ruling of Allah has impliedly entered into His Din; and whosoever refuses that has exited from His Din. So this is the understanding of every Muslim whose understanding is sound – concerning Allah Ta’ala under these clear verses.

He – Ta’ala – said

((أم لهم شركاؤاْ شرعواْ لهم من الدين مالم يأذن به الله، ولولا كلمة الفصل لقضي بينهم، وإن الظالمين لهم عذاب أليم)) الشورى: 21

“Or have they partners with Allah (false gods), who have instituted for them a religion which Allah has not allowed. And had it not been for a decisive Word (gone forth already), the matter would have been judged between them. And verily, for the wrong-doers, there is a painful torment.” ((Shura: 21))

Indeed Allah Ta’ala has called legislation Din and the legislation of Allah is His Din and whosoever holds unto it has taken a Din to Allah and subject himself to Him; and whosoever refuses the Shari’ah of Allah Ta’ala and holds unto the Shar’ of other than Him has associated partners with Allah and has entered into the Din of the Mushrikin – we seek Allah’s refuge from misguidance.

And Allah Ta’ala has refutted the claim of the one who claims to be a believer while at the same time referring judgement back to other than the Hukm of Allah; and it is the Hukm that Allah Ta’ala referred to as Taghut:

((ألم تر إلي الذين يزعمون أنهم ءامنواْ بما أنزل إليك وما أنزل من قبلك يريدون أن يتحاكمواْ إلي الطاغوت وقد أمرواْ أن يكفرواْ به، ويريد الشيطان أن يضلهم ضلالا بعيدا* وإذا قيل لهم تعالواْ إلي ما أنزل الله وإلي الرسول رأيت المنافقين يصدون عنك صدودا)) النساء: 60-61

“Have you seen those (hypocrites) who claim that they believe in that which has been sent down to you, and that which was sent down before you, and they wish to go for judgement (in their disputes) to the Taghut while they have been ordered to reject them. But Shaitan wishes to lead them far astray. And when it is said to them: “Come to what Allah has sent down and to the Messenger (SAW)” you see the hypocrites turn away from you with aversion.” ((An-Nisa: 60-61))

So, this is the situation of whosoever refers judgement to these false and Kufr constitutions. So what is the condition of the one who promulgates it and obligates its execution on the people? So these ones without a doubt are more deserving of been put under these verses and the rulings that come out from them. Rather, he is a Taghut according the texts of the Honoured verses.

And based on this, indeed these Rulers who change the Shari’ah of Ar-Rahman are Kuffar and apostates and this ‘tabdil’ is Kufr according to the Kitab (Book of Allah), the Sunnah and the Ijma of Ahlissunnah with the exemption of the very insignificant ones that stand alone among the Murji’ah, Jahmiyyah and the Innovators.

And our Imams – may Allah be merciful to them – have extended their explanations of that in many different texts whose explanation and commentary have been prolonged. And nothing is required from the Seeker after Truth but to abandon dogmatism to individuals on one hand and to take off himself the garment of whims, passions and ignorance, and to look at this Mas’alah justly and separated from misconceptions and desires, and he shall, by the bounty of Allah Ta’ala see that the Truth is in what we have preceded about this issue (Mas’alah).

And among these Imams are Imam Ahmad bn Taymiyyah, Ibn Qayyim, Ibn Kathir; and after them Muhammad bn AbdulWahhab, Shaykh Ahmad Shakir, Mahmud Shakir, Shaykh Muhammad Amin Shanqeeti and many others apart from them who have spoken about this issue with knowledge and awareness.

But for those who try to hide this knowledge from the people either by refusing to make it known or by blemishing it and mixing it up, then:

((و جعلواْ الملآئكة الذين هم عباد الرحمن إناثا، أشهدواْ خلقهم، ستكتب شهادتهم ويسئلون)) الزخرف: 19

“And they make the angels who themselves are slaves to the Most Beneficient (Allah) females. Did they witness their creation? Their evidence will be recorded, and they will be questioned!” Zukhruf: 19

Thus O Muslim Brother!

Seal your ears and ask Allah Ta’ala for guidance in what the people are differing about just as it was in the du’a of the prophet (SAW), especially in this era in which Islam has become strange and the Trust has become snatched and the people of Truth have become the Strangers.

May Allah make me and you among the people of Truth and Din, the Din of the followers of Muhammad (SAW) the prophet of Trust.
