#242: Ruling on Eating or Drinking while Standing and Walking

ANSWER
Alhamdulillaah!
The Ulamaa, as Ibn Hajar Al-Asqalaani mentioned in Fat’hu al-baari, have formed a consensus on the fact that drinking while standing is not a Haraam. This is the consensus of the vast majority of the Fuqahaa. Only a few among them differed on that.
It is reported by An as Ibn Maalik – radiyallaahu an hu – as was recorded by Imaam Muslim, that the Companions were forbidden, during the time of the Rasul – salallaahu alayhi wasallam – from drinking while standing. When Anas Ibn Maalik – radiayallaahu an hu – was asked of the ruling of eating while standing, he said: ‘that is worse and more repugnant’.
However, there is a Hadith transmitted and recorded by Imaam Ahmad in the Musnad and At-Tirmidhi in his Sun an from Abdillah Ibn Umar – radiyallaahu anhuma – that he said:
“We used to eat while we were walking during the lifetime of the Messenger of Allah – salallaahu alayhi wasallam – and we drink while standing.”
Al-Mubaarakfuri – rahimahullaah – said:
“In it is evidence for the permissibility of eating while walking. As for the Hadith of Anas that was mentioned in the previous chapter, it implies prohibition. So the Hadith of Anas will be understood as a prohibition by way of dislike and the Hadith of Ibn ‘Umar to mean permissibility but dislike. This is the understanding that reconciles the two Hadiths.”
