#40 ZAKAATUL AL-FITR FOR UNBORN BABIES

Pls does zakatul fitr include unborn baby i.e if ones wife is pregnant and ones child that is staying with ones brother/sister?”
ANSWER
Wa alaykum salaam warahmatullaah wabarakaatuh.
Alhamdulillaah, may Allaah reward you abundantly too, aameen.
What the majority of the Fuqahaa hold is that Zakaatu Al-Fitr is only obligatory on a new born that was born before the sunset on the last day of Ramadaan (I.e. on the day the moon of Id was sighted).
This is the Fatwa of the Hanbalis, the preponderant to the Shaafi’is and one of the positions held by the Maliki Imams.
Therefore, if your new child was not born before the sunset time (maghrib) of today, Zakaatu Al-Fitr is not obligatory on his behalf.
As for your child staying with your brother or sister, it remains an obligation that zakaatu Al-Fitr be made on his/her behalf either by you or by your brother/sister under whose shelter he lives.
