#94. PERMISSIBILITY FOR A WOMAN TO SEEK DIVORCE DUE TO SEXUAL INSATISFACTION

ANSWER
Wa alaykum salaam warahmatullaah wabarakaatuh
May Allah reward you too and accept all our du’aa, aameen.
Sexual satisfaction is relative, and it depends on the level of satisfaction to which she refer.
The Ulamaa have formed a consensus that if a man is impotent in such a way that he cannot penetrate his wife during sexual relations, then it is permissible for her to seek for divorce from him. At the same time, if he is able to penetrate her but is not able to get her pregnant and it is established that there is some illness in him that hinders her getting pregnant, she may also seek for a divorce from him.
If however he is able to get her pregnant but she only seeks more on that, it isn’t permissible for her to seek for divorce from him. This is as long as there is no medical deficiency in him that leads to that. What is obligation on him is in accordance to his capability.
Shaykhu Al-Islaam Ibn Taymiyyah – rahimahullaah – said in the Fataawah:
“And it is obligatory upon the man to have inter course with his wife in accordance with the tradition. And it is of the most stressed rights of hers upon him that is greater than feeding her. As for the intercourse that is Waajib, it has been said that it is obligatory at least once in four months. And it has been said that it is in accordance to her needs and his capability. This (later) is the most correct of both positions.”
What is obligatory upon her in such a situation is to ensure that she helps him satisfy her, and helps him with Halaal stimulants to support his weakness. Not to seek for divorce.
And a woman should be possessed of insight and deep thought whenever considering a great thing such as divorce. This is due to the sort of great things that follow that decision.
