الحمد لله رب العالمين والصلاه والسلام على سيد الأولين و الآخرين
وعلى اله وصحبه اجمعين ومن تبعهم بإحسان إلى يوم الدين

Assalāmu Alaykum Warahmatullāh Wabarakātuh
Honored brothers and sisters on this Platform
You are welcome to this morning’s session of the Halqah
We ask Allāh to make it beneficial to us and to you, amīn
We shall respond to few of the pending questions

*QUESTION*
*ON TAKING OFF THE SHOES AT THE GRAVEYARD*
_”Assalaamu alaykum warahmatullāh .Please admin my question is, are we to pull off our shoe while entering a graveyard?”_
*ANSWER*
Wa ‘Alaykum Salām Warahmatullāh Wabarakātuh
Know, may Allāh be merciful on us altogether that the majority of the Ulamā have permitted the entering of the grave with the shoes.
This was the position favoured by the Hanafis, the Mālikis and the Shāfi’īs.
It is also narrated from Al-Hasan Al-Basrī and Ibn Sīrīn among the Tābi’īn
This position was also shared by Imām Abū Muhammad bn Hazm Al-Andalusī – rahimahullāh – as established in the Muhallā
Except that Ibn Hazm Al-Andalusī made an exemption and excluded the Shoes made from _Sabtiyyatayn_ (Tanned Hide).
This is because of the Sahih Hadith recorded by Abū Dāwud from Bashir Ibn Ma’abad that the Rasūl – salallāhu ‘alayhi wasallam – commanded someone walking the graveyard with the _Sabtiyyatayn_ (Leather Shoes made from Tanned Hides) to pull them off.
Al-Qādī Abū Ya’ala – rahimahullāh – shared this position with Ibn Hazm
The Hanbalī Schools differed with this position and held that it was Makrūh (A Legal Dislike) altogether
And Imām Ahmad – rahimahullāh – considered the Hadīth of Bashir Ibn Ma’abad to be the deciding factor on this matter.

Then, Imām Ash-Shawkānī – rahimahullāh – held a Stern position that it was Harām to wear shoes in the graveyard altogether. This he established in his illustrous book _Naylu Al-Awtār_
This altogether gives four distinct positions
The position of the majority that it is permissible to enter the graveyard with shoes
The position of the Hanbalis that it is Makrūh
The position of Ibn Hazm and Abū Ya’ala that it is the _Sabtiyyah_ that is Harām
The position of Ash-Shawakāni that it is Harām
What is strong, and Allāh knows best is that it is recommended to take off the shoes and it is Sunnah
Except when it is feared that thorns and filth may harm the feet
Ibn Qudāmah Al-Maqdisī – rahimahullāh – said in Al-Mughnī
_”And he takes off the shoes whenever he enters the graveyard. This is recommended…”_
Shaykh Muhammad Sālih Al-‘Uthaymīn – rahimahullāh – said
_”To walk in the graveyard with shoes is opposed to the Sunnah. And what is better for a person is to take off his shoes when he walks in the graveyard unless there is a need…”_
This puts the Hanbalī position as the strongest, and Allāh knows best.

*QUESTION*
*WHAT IS OUR OBLIGATION TOWARD MASJID AQSA?*
_”Salamu aleikum, My question is what’s Muslims right toward masjidul aqswo; the one in Jerusalem and what’s the need for fighting for it. Jazakumu Allahu khair as you answer.”_
Wa Alaykum Salām Warahmatullāh Wabarakātuh
Alhamdulillāh!
The responsibility and obligation of the Muslim Ummah toward Masjid Aqsa is Jihād in all of it’s Ramifications toward it’s liberation
The Ulamā have formed a consensus that it is obligatory upon the Muslims to wage a Jihād to repel an aggression against the Muslims, everybody in his own capability and capacity
Shaykh Al-Islam Ibn Taymiyyah – rahimahullāh – said in the _Majmū’ Al-Fatāwah_
_”As for defensive Jihād, then it is the most important kind of repelling an aggression on a person’s sanctity and Dīn. This is obligatory by consensus. Since the invading enemy that destroys the Dīn and the Dunya, there is nothing more Obligatory after Īmān than repelling him. The Fellows of our School and others have mentioned that.”_

The Hanafī Imām Ibn ‘Ābidīn Al-Hanafī – rahimahullāh – said in his Hāshiyah
_”If the enemy attacks a front among the frontiers of Islām, it is Fard ‘Ayn upon Whomsoever is close to that frontier to repel them. And then it is Fard Kifāyah for those who are distant as long as they are not needed. But if they are needed in such a way that those who are next to the enemy are incapable of the repulsion or they are lax and fail to do wage the Jihād, then it becomes obligatory upon those who are next to them, a kind of obligation that is in Salāt and Sawm (fasting), it is impermissible for them to abandon it. And then from them to the next in proximity, and then the next in proximity, until it reaches all of the Muslims West and East.”_
This position is shared by the Hanafī Imams, all of them
And similar was held by the Mālikis, the Shāfi’īs and the Hanbalī Imams
And because the Land of Palestine has been under enemy occupation for almost a century and the people that surround it have been incapable so far, it becomes obligatory upon the entire Muslim Ummah
The obligation is upon every Muslim, male and female, to give whatever he can to the Palestinian Cause, and to set forth for it’s liberation with respect to his capability, and Allāh is He we ask, to bring unto us a time soonest when the Muslim Ummah will regain it’s Lost lands, amīn

*QUESTION*
*THE RULING OF ADVERTISING ON WEBSITES*
_”Assalam alaikum. Please what’s the ruling on earning from advertising websites in Islam??”_
*ANSWER*
Wa ‘Alaykum Salām Warahmatullāh Wabarakātuh
Alhamdulillāh
This is Permissible and allowed as one of the transactions that involves commissions, as long as the Website and/or the goods that are advertised are not transactions or promotional dealings that are Harām
Most companies for instance, love to advertise on porn sites as they anticipate a great deal of traffic on such sites
It is Harām for any Muslim to be involved in this kind of dealing
Likewise, it is Harām for any Muslim who owns a high traffic site for instance to give audience to a company that deals in Harām such as Alcoholic Companies to place their advertisements on his website. This would amount to aiding and abetting the promotion of their Harām dealing company.

Same applies to a company that deals in Halāl but which is known for it’s war against Muslims or whose proceeds are used to finance a war against Islām and Muslims
May Allāh bless the Muslim Ummah with Halāl wealth and dealings, Amin
