#148: Can a Woman Give Charity to Her Parents Without Her Husband’s Permission?
*ANSWER*
Wa alaykum Salām Warahmatullāh Wabarakātuh
Alhamdulillāh.
If the wealth with which she intends to do the Sadaqah is from the husband’s wealth, then the Ulamā are at a consensus that she must seek the husband’s permission. That is because it is not permissible to make Sadaqah with somebody’s wealth without his permission.
However, if the wealth were to be hers, the position held by Imām Abū Hanīfah, Ash-Shāfi’ī and one of the narrations from Imām Ahmad is that it isn’t compulsory but recommended of her to seek the permission and advice of her husband before she does that.
Imām Mālik’s verdict, and the second narration from Imām Ahmad is to the effect that she must not give out more that a third of her wealth without the husband’s permission.
Both positions have their evidences but the former holds more weight.
